By using this site or placing an order you agree to these terms. Please read them alongside our refund policy, shipping policy and privacy policy, which form part of them.

Who can order

You need to be at least 18 years old and able to enter into a contract, and you need an Australian delivery address. We sell to consumers for personal use, not for resale.

Orders

Placing an order is an offer to buy. The order confirmation email is an acknowledgement that we received it, not acceptance. The contract is formed when we email you to confirm that your order has been dispatched.

We may decline or cancel an order, and will refund you in full if we do, where the item is unavailable, where we cannot deliver to your address, where there has been an obvious pricing or description error, or where we reasonably suspect fraud.

Prices and payment

Prices are in Australian dollars and include any taxes payable. Shipping is free. Prices can change, but a change never affects an order we have already accepted.

We take payment when you place your order, through the payment methods shown at checkout. Your card details are handled by our payment providers; we never see or store your full card number.

We do our best to keep prices and product details accurate. If an obvious error slips through, we will contact you before dispatch and you can confirm the corrected price or cancel for a full refund.

Products, photos and descriptions

We describe the kit as accurately as we can, including what is in it and what is not. Photographs are there to show you the product; colours can look slightly different on different screens, and packaging can change. Minor differences of that kind do not mean the item is faulty.

This kit is intended for routine car cleaning. Use each item for its intended purpose and follow any instructions supplied with it.

Delivery, risk and ownership

Delivery times and costs are set out in our shipping policy. Risk in the goods passes to you when they are delivered to the address you gave us. Ownership passes once we have received payment in full.

Your consumer rights

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law. Our 30-day change-of-mind return is offered in addition to those rights.

Our liability

Where the law allows us to limit our liability, and only to that extent, our liability for a failure to comply with a consumer guarantee is limited to replacing the goods, supplying equivalent goods, repairing them, or refunding what you paid. We are not liable for loss that was not reasonably foreseeable, or for loss caused by using an item for something it was not meant for or contrary to its instructions.

None of this applies to liability that cannot be limited by law, including under the Australian Consumer Law, or for fraud.

Using this site

The text, photographs, logos and design on this site belong to us or our licensors. You are welcome to view and share pages; please do not copy our content for commercial use without asking.

Do not use this site to break the law, to interfere with how it works, or to collect data from it automatically.

We try to keep the site available and accurate, but we may change, suspend or withdraw parts of it, and we do not promise it will always be error-free.

Privacy

How we handle your personal information is set out in our privacy policy.

Changes to these terms

We may update these terms from time to time. The version that applies to your order is the one published when you placed it.

Law and disputes

These terms are governed by the law of the Netherlands. This does not take away the protection given to you by the mandatory consumer law of the place where you live, including the Australian Consumer Law, and you can bring proceedings in the courts of your state or territory.

If something goes wrong, email contact@backseatco.com first. We would much rather fix it directly. You can also contact the Australian Competition and Consumer Commission or your state or territory consumer protection agency at any time.
